Terms of Service

1. General Provisions and Definitions
These terms ("Terms") define the rules and conditions for the provision of electronic services via the SlotCatcher web application, available at slotcatcher.eu.
The Service Provider is:

Definitions:
• "User" — an entrepreneur (salon, studio, or practice owner) using the application for business purposes;
• "Client" — a natural person signing up for a User's waitlist;
• "Account" — an individual User profile enabling access to the Service;
• "Rescue" — a notification sent to Clients about an available appointment slot.
Acceptance of these Terms is required to create an Account.
2. Type and Scope of Services
SlotCatcher is a SaaS (Software as a Service) application that allows Users to:
• create and manage digital waitlists;
• send SMS and/or email notifications to Clients about available slots;
• share a public waitlist sign-up link;
• track notification history and booked appointments.
SlotCatcher provides a technological tool only and is not a party to agreements between Users and their Clients. The Service Provider is not responsible for the content, quality, or delivery of services provided by Users.
3. Service Conditions and Technical Requirements
To use the application, you need:
• a device with Internet access;
• a current version of a web browser (Chrome, Safari, Firefox, or Edge);
• an active email address.
Users are prohibited from providing unlawful, offensive content, content violating third-party rights, or malicious software. The Service Provider reserves the right to suspend or block an Account in case of violation.
4. Registration and User Account
Registration requires providing accurate and current data (name, email, password, business name) and constitutes entering into an agreement for the provision of electronic services.
The User agrees to:
• provide truthful data and keep it updated;
• keep login credentials confidential;
• promptly report suspected unauthorized access.
The Service Provider is not liable for damages resulting from sharing login data with third parties.
5. Free Trial
New Users may take advantage of a free 14-day trial period with access to features of the selected plan.
After the trial ends, if the User does not activate a paid subscription, the Account will be limited to free plan features. Data and waitlists will be preserved.
The Service Provider reserves the right to modify trial conditions.
6. Payments and Subscriptions
Advanced features require a paid subscription (Start, Pro, Premium). Payments are processed cyclically in advance (monthly or annually) via Stripe Payments Europe Ltd. The Service Provider does not store payment card data — it is processed by Stripe in compliance with PCI DSS.
Prices in the application are net prices — applicable VAT is added. Users may cancel their subscription at any time from Account settings. Fees for a started billing period are non-refundable unless required by law.
7. User's Responsibility towards Clients
The User (salon) acts as the initiator of SMS and email communications. The User declares and warrants that they possess all legally required consents from Clients to send notifications, in accordance with:
• the Polish Electronic Services Act;
• the Polish Telecommunications Law;
• the GDPR.
SlotCatcher assumes no liability for the lack of appropriate consents on the part of the User.
8. Intellectual Property Rights
All copyrights, trademarks, source code, interface, and other elements of the application are the exclusive property of the Service Provider, protected under copyright law and industrial property law.
Copying, modifying, decompiling, reverse engineering, or using application elements without the Service Provider's written consent is prohibited.
9. Limitation of Liability
The Service Provider makes every effort to ensure uninterrupted service but does not guarantee complete fault tolerance.
SlotCatcher is not liable for:
• interruptions caused by force majeure;
• external infrastructure failures (SMS gateways, servers, telecom operators);
• errors resulting from User actions.
Total liability is limited to the amount paid by the User in the last 3 months. Liability for lost profits (lucrum cessans) is excluded.
10. Complaints
Complaints should be submitted to: hello@slotcatcher.eu. Each complaint should include a description of the issue and User details.
The Service Provider will address complaints within 14 days of receipt and notify the User of the outcome electronically.
11. Termination and Account Deletion
The agreement is concluded for an indefinite period. The User may terminate it at any time by deleting their Account in the application settings.
The Service Provider may terminate the agreement with immediate effect in case of gross violation of the Terms or the law.
After Account deletion, User data is retained only as required by tax and accounting regulations.
12. Out-of-Court Dispute Resolution
Users who qualify as consumers or sole proprietors (under applicable Polish civil law) may use out-of-court complaint and claim resolution methods, including:
• Mediation conducted by provincial inspectorates of the Trade Inspection;
• The ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.
Out-of-court dispute resolution is voluntary and requires the consent of both parties.
13. Final Provisions
In matters not covered by these Terms, the relevant provisions of Polish law apply, in particular:
• the Civil Code;
• the Act on Provision of Electronic Services of 18 July 2002;
• the Consumer Rights Act of 30 May 2014;
• the GDPR.
Any disputes will be resolved by the court competent for the Service Provider's registered office. The Service Provider reserves the right to amend these Terms, notifying Users at least 14 days before the changes take effect.
